Minister Creecy publishes draft amendments to environmental authorisation applications for renewable energy facilities and exclusions from obtaining environmental authorisations

On 28 July 2023, the Minister of Forestry, Fisheries and the Environment gave notice of her intention to require that a letter of consent from Eskom Holdings Ltd be submitted with an application for environmental authorisation for certain prescribed activities when proposed within a specific distance of a main electricity transmission or distribution substation.
The Notice similarly requires such a letter to be accompanied with a request for registration of an exclusion from the requirement to obtain environmental authorisation for the prescribed activities proposed within the specific distance of a main electricity transmission or distribution substation.
The Minister indicated that the proposed changes are necessary to ensure unrestricted access to the transmission and distribution substations.
The public is invited to submit comments on the proposed amendment within 30 days.
