Town-Planning and Townships Ordinance No.15 of 1986

10 June 1987

Ordinance 15 of 1986, assented to on 18 December 1986, commenced on 10 June 1987. This Ordinance is applicable in Gauteng, Mpumalanga, North West and Limpopo Provinces. It is also known as the Transvaal Ordinance.

Section 139 of the Ordinance was declared constitutionally invalid by the Constitution Court on 10 November 2016 in the matter of Pieterse N.O. and other v Lephalale Local Municipality and other.

Repeal of the Ordinance


Section 24 of the Constitution of the Republic of South Africa, 1996

Everyone has the right to an environment that is not harmful to their health or well-being; and to have the environment protected, for the benefit of present and future generations, through reasonable legislative and other measures that prevent pollution and ecological degradation; promote conservation; and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.
