This casebook was developed to empower communities who are faced with applications for prospecting or mining on their land. It aims to empower communities through knowledge of the law. It describes the most important law that applies to prospecting and mining in South Africa and shares the experience of four communities who have successfully used law to challenge the way in which mining is taking place on their land.

Everyone has the right to an environment that is not harmful to their health or well-being; and to have the environment protected, for the benefit of present and future generations, through reasonable legislative and other measures that prevent pollution and ecological degradation; promote conservation; and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.
