Air Quality Act came into full operation on 1 April 2010

On 1 April 2010, all the remaining provisions of the National Environmental Management: Air Quality Act, 2004 (Act 39 0f 2004) came into effect. These include, in particular, all the provisions dealing with atmospheric emissions licences (including criminal offences), and section 60, which repeals the Atmospheric Pollution Prevention Act, 1965 (Act 45 of 1965). RIP APPA.

Listed activities that  require an atmospheric emission licence under AQA from 1 April 2010 were also be promulgated on 1 April 2010 and are available here.

Everyone has the right to an environment that is not harmful to their health or well-being; and to have the environment protected, for the benefit of present and future generations, through reasonable legislative and other measures that prevent pollution and ecological degradation; promote conservation; and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.
