Section 24 of the Constitution of the Republic of South Africa, 1996 Everyone has the right to an environment that is not harmful to their health or well-being; and to have the environment protected, for the benefit of present and future generations, through reasonable legislative and other measures that prevent pollution and ecological degradation; promote conservation; and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.

Pollution, waste and land use

In October 2011, with support from the Global Greengrants Fund, the Centre started a pilot project with partners groundWork, the South Durban Community Environmental Alliance and the Vaal Environmental Justice Alliance focused on strengthening civil society participation in decisions on industrial pollution, waste and land use.

The objectives of this project, to be achieved through ongoing legal advice, legal research, legal representation and liaison with existing legal representatives of partner organisations, are as follows:

  1. to empower our partner organisations and their stakeholders (communities, community organisations and civil society organisations) through an understanding of the law and how the law is able to strengthen their struggle for environmental justice;
  2. to improve environmental decision-making in relation to pollution, waste and land use through improved civil society participation; and
  3. to hold both government and industry to their obligations under the Constitution and applicable laws.
