Section 24 of the Constitution of the Republic of South Africa, 1996 Everyone has the right to an environment that is not harmful to their health or well-being; and to have the environment protected, for the benefit of present and future generations, through reasonable legislative and other measures that prevent pollution and ecological degradation; promote conservation; and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.

2010 EIA Regulations

See the full page on the National Environmental Management Act, 1998 (NEMA) and all its regulations, including both the 2006 and the 2010 EIA Regulations with their respective Listing Notices, here. The 2010 EIA Regulations was brought into effect on 2 August 2010.

Further amendments to the EIA Regulations and Listing Notices 1 and 2 published in R.660 of GG33411 with effect 2 August 2010. Importantly, Listing Notice 2 has been amended to include a new Activity 26: “Commencing of an activity, which requires an atmospheric emission license in terms of section 21 of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004), except where Activity 28 in Notice No. R. 544 of 2010 applies”.
