Section 24 of the Constitution of the Republic of South Africa, 1996 Everyone has the right to an environment that is not harmful to their health or well-being; and to have the environment protected, for the benefit of present and future generations, through reasonable legislative and other measures that prevent pollution and ecological degradation; promote conservation; and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.

Corporate Status

The Centre for Environmental Rights NPC is a non-profit company with registration number 2009/020736/08. You can download its company registration documents (including its Certificate of Incorporation, Memorandum and Articles of Association) here.

The Centre is accredited as a non-profit organisation with the Department of Social Development under the Nonprofit Organisations Act, 1997 with reference numberĀ  NPO No. 075-863.

The Centre is also registered with the South African Revenue Service as a public benefit organisation under the Income Tax Act, 1962 with reference number PBO No. 930032226. You can download our PBO registration certificate here. This means that:

  • the Centre is exempt from taxes and duties on receipts and accruals;
  • donations and bequests to the Centre are exempt from donations tax and estate duty; and
  • donations to the Centre are tax-deductible in the hands of the donors (subject to certain limitations).

In July 2010, the Centre received its accreditation as a Law Clinic in terms of Rule 19 of the Law Society of the Cape of Good Hope.
